GENERAL TERMS

This website is a presentation site and an eShop selling wines through the internet (hereinafter referred to as the “Vassaltis”) of the company with the following legal details:

 

These Terms of Use set, in a clear and comprehensible manner, the terms governing and regulating the relations of the Company with each visitor and/or customer of the Vassaltis in accordance with Law 2251/1994 on the “Protection of Consumers” and Law 2472/1997 on the “Protection of Individuals with regard to the Processing of Personal Data”, as currently in force.

These Terms of Use, conditions and regulations on the purchase of goods governing the Vassaltis apply exclusively to it and do not govern, in any way whatsoever, the operation of any other companies or shops affiliated therewith.

Every entry, browsing and transaction of yours with the Vassaltis makes you a visitor and/or customer thereof. Access to and use of the Vassaltis, as well as the services and products made available through it are subject to these Terms of Use. In order to use the services provided, your prior consent to all the Terms of Use of the Vassaltis, as in force at each time, is required; therefore, prior to proceeding with browsing the Vassaltis, please read carefully and understand these terms in order to be sure that you accept same, since any use and/or transaction you may enter into with the Company via the Vassaltis implies the full and unconditional acceptance of these terms on your side.

The Company reserves the right to amend or renew the Terms of Use, as well as the conditions of transactions. If you use the Vassaltis after a notice of amendment of the Terms of Use has taken place, it means that you agree to the new Terms of Use. For this reason, it is recommended that you check the contents thereof whenever you use this site in order to be informed of any eventual amendments to the Terms of Use. The use of the Vassaltis, after you have been informed of the applicable terms of use at each time, implies acceptance thereof.

Access to the Vassaltis is permitted throughout its operation for people of age over 18. The Company reserves the right to withdraw or discontinue the provision of services at any time without prior notice. The Company is not responsible in case of any failure to access all or part of the services for any reason whatsoever.

The Company makes every effort in order to ensure that the contents of the Vassaltis contain complete, accurate, clear, valid, informative, up-to-date, truthful and non-misleading information. In any case, however, the Company bears no liability or warranty whatsoever as regards the safety and contents of the Vassaltis. Users of the Vassaltis accept the possibility that the Company may be unable to control all of its contents and services. In addition, the Company does not warrant that the use of information, data or material included in the contents of the Vassaltis by users will not violate any third parties’ rights.

Τhe use of the Vassaltis is on your sole responsibility and its contents do not constitute nor can, in any way, be interpreted as counseling or direct and indirect incitement to proceed to any action or act. The evaluation of the contents lies upon any user who assumes responsibility for the use of any part thereof.

 

PERSONAL DATA

The Company ensures that the Vassaltis is in compliance with the provisions of Law 2472/1997 on the “Protection of Individuals with regard to the Processing of Personal Data”  and Law 3471/2006 on the “Protection of Personal Data and Privacy in the Electronic Communications”. In any case, the Company asserts that any collection, processing and/or storage of your personal data is carried out according to the law and only upon your express specific consent and solely and exclusively for the purposes and to the extent necessary for the operation of the Vassaltis.

The Company asserts that it will not use your personal data for any use not specifically authorized by you, nor will send or disclose your data to any third parties (natural or legal entities) not affiliated with the Company, without your express and specific consent to this effect, except in cases where disclosure is necessary in order for your order to be carried out (e.g. cooperating shipping companies) or if it is mandatory by law.

Although surfing the Vassaltis is possible even without the disclosure of information that is considered to be personal data, you may benefit from more services if you agree to disclose certain personal data, depending on the service you are interested in at each time.

In any case, a necessary requirement for initiating and processing your transaction with our Company is the disclosure by you of certain personal data, such as your full name, contact details and your address for sending your order, etc. Your payment details (e.g., the number of your credit card) are not collected or stored by the Company, so you need to re-register them each time you want to make a transaction through Vassaltis.

Upon successful completion of your transaction with the Vassaltis you are automatically registered to it through the creation of a personal account where the information of your order is saved. For the completion of your registration, you will receive an email with further instructions in order to set your Personal Password.

The safe entry into the Vassaltis is achieved via “password”.

The codes used in order to identify you are two:

A. The Email

B. The Personal Security Code (password)

Each time you enter the above codes, you gain safe access to your personal data.

You remain solely and exclusively responsible for all transactions carried out under your personal codes as well as for the correct use of your codes, whilst the Company is not liable for any damage or loss resulting from non-observance of these terms. You agree to promptly notify the Company for any unauthorized use of your codes and any existing and/or potential security violation.

The Company has no liability whatsoever in case of loss of data since it has taken all possible measures to safeguard same.

By entering the data, the visitor and/or customer agrees to: (a) provide true, accurate, valid and full information as regards the information requested by the Vassaltis in the relevant applications in order to have access to its contents/services and (b) maintain and diligently update his/her registration data in order to always be true, accurate, valid, updated and complete.

Underage visitors to the Vassaltis may have access to it and its services only with the consent and under the supervision of their parents or guardians without being required to submit their personal data. Should such data be submitted by underage persons, the Company immediately deletes them, given its prior notification, since there is no other way to know it.

The Vassaltis enables its visitors/customers to access the record wherein their personal data is kept, which is collected and stored as above, and to make corrections, deletions, modifications and additions to the data and information contained therein.

A visitor/customer can subscribe to the Vassaltis Newsletter in two ways. In particular he/she can opt in:

a. at the final stage of ther order submission process by selecting the respective check box or

b. during his navigation at the Vassaltis by entering his/her email in the Newsletter field available on every page

In order to avoid any erroneous subscription to the service by a third person, the double opt-in process gives the right to the user to confirm his consent through a link sent to his personal email. It is only then, when the subscription is activated. If the visitor/customer wants to stop receiving the marketing emails, he/she can unsubscribe from the service through the unsubscribe link available at the end of each marketing email or by updating his/her profile settings following the link that has been sent to him/her during the first time subscription.

 

SAFETY – COOKIES – LINKS

For safely surfing the Vassaltis, as well as for the safety of your transactions with it, the Company takes all appropriate steps, by adopting modern high quality safety standards in line with market trends, and uses TLS 1.2 with cryptographic protocol 128-bit (Secure Sockets Layer – SSL), which are put into operation upon the entry of sensitive personal data offering codified communication. The Company takes the necessary measures in order to protect your personal data, but you should also keep in mind that safe surfing on the Vassaltis as well as the protection of your password into your personal account depends on you as well.

The Vassaltis has the possibility to use cookies in order to provide visitors/customers with information and better services (order status, personal settings, etc.) as well as with more efficient and direct order processing. Cookies are small alphanumeric files that are sent and stored on the computer of each visitor/customer, by saving settings and choices you have already made to the Vassaltis so that they pop up automatically during your next visits to the Vassaltis and facilitate the Company to better understand how you use the Vassaltis. It should be noted that cookies do not damage the visitor’s/customer’s computer or the files stored on them. However, it should be clarified that through your browser settings you can at any time delete previously stored cookies, in order to prevent the installation of new cookies, or request to be asked each time a cookie is to be installed on your computer (for more information, please contact your browser’s page).

At the Vassaltis, it is possible to find links that lead to other websites managed by third parties or owned by third parties (natural or legal entities) not linked to the Company or the Vassaltis. The use of these links is subject exclusively to their own terms of use, for which you should be informed. The Company and the Vassaltis have no liability whatsoever as regards the contents of these linked websites and their use by visitors/customers. The indication of such links does not imply a statement by the Company as far as the reliability, security and contents of these links are concerned, nor for the services and products provided through them, and the connection to these links is carried out on the sole responsibility of the visitors/customers. For this reason, for any issue that may arise during your surfing on these linked sites or in connection with your transactions with them, please contact directly the administrators thereof, which are exclusively liable for these websites.

 

PURCHASE POLICY

General terms

The Vassaltis serves customers in all countries.

Orders placed with the Vassaltis are subject to the Company’s approval. The acceptance of the order by the Company is given by sending a relevant email. The Company reserves the right to refuse to process an order in case of unavailability or removal of the products.

The information contained in this website and these Terms of Use is not a sales proposal but a call for information. No contract will be deemed to have been concluded as regards any of the products unless your order has expressly been accepted by the Company.

The price of each product is the one referred to on our website, next to each product and includes VAT (24%). These prices concern products and quantities available in the Company’s warehouse.

The Company reserves the right to change, without notice, the items available, their prices, the shipping charges as well as the mode of operation of the Vassaltis. For this reason, it is recommended that you be informed of the terms of use thereof each time you use this website.

Placing/Cancellation of an order

Placing a Product order is a binding purchase proposal for these Products in the total price shown at the time of placing the order; such a price includes VAT, packing and shipping costs, other applicable charges and any discounts you are entitled to as a visitor/customer. Your order is completed when the Company has accepted it by sending a relevant written confirmation, namely an email, to you at the email address you had provided when placing this order. Should you not receive a confirmation email for your order, please contact the Vassaltis immediately at i[email protected] in order to request that your order be successfully completed.

An order that has been registered and has not yet been delivered may be canceled (in whole or in part), within the time period between its submission and the notice of confirmation of its shipment. After this moment, it is not possible to cancel it. For any cancellation of an order (in whole or in part), you should send an e-mail to [email protected] or call (+30) 2286 022211

Payment

A. By bank transfer

You can transfer the amount required for your orders within a limited period of five (5) business days from the date of placing your order. Otherwise, your order will be deemed as cancelled.

The bank deposit slip must include as a reason:

1. Your full name

2. Your order number, which will be sent to you by email upon the completion of the ordering procedure.

B. By charging your credit card

The payment of your order can be safely carried out by credit, debit or prepaid VISA, MASTERCARD MAESTRO card of any bank.

For additional safety of your online credit card transactions, these are carried out via Eurobank e-Commerce system. For maximum safety of service, the bank applies state-of-the-art methods in order to keep your transactions intact, protect your data and safeguard same from the access of any third parties. Thus, the transactions you make with us through credit cards are absolutely safe. We do not collect or store your credit card information in any way whatsoever, so you need to re-register each time you use your credit card for transactions.

 

Shipment

Your order will be sent to you after we have received and confirmed your payment.

The Products will be shipped by courier within three to five (3-5) business days at the latest as of the date your order was confirmed, to the place you have indicated when placing your order and in accordance with the availability stated on the product webpage.

Once the order has been dispatched, an informative email will be sent. Handling, dispatch and delivery of orders are carried out on a daily basis, except Saturdays, Sundays and public holidays.

Upon receipt of your product, we recommend that you personally check the product delivered and confirm that its packaging remains intact.

Shipping cost

Orders over €200.00 are shipped free of charge within Greece.

For orders under €100, shipping cost throughout Greece is set at 15.00 €.

For items with an increased weight, there may be an extra charge.

Outside Greece the costs differ and are calculated dynamically at order level

Return policy

General terms

You may return products you purchased and request either their change with another product or products or a refund within a maximum time period of fourteen (14) calendar days from the day following their receipt. No right for a refund or change exists once the abovementioned period has expired.

The return of the products is carried out at your own risk, using a courier cooperating with our Company and you are not burdened with transport and insurance costs.

To qualify for the return or replacement of a product, the following conditions must cumulatively be met:

a. The product to be in its original condition, undamaged and unused within its packaging.

b. To have been received, checked and approved by the Company.

C. To be necessarily accompanied with the original receipt and/or the gift receipt that accompanies it, showing the code of the item and the date of purchase.

Returns that do not meet the above conditions will not be accepted.

 

Return Procedure

The product return procedure is simple and is carried out as follows:

Within the abovementioned time period, you should inform the Company by email at [email protected] indicating your full name and your order number, of the reasons for which you wish to return the product as well as whether you wish to replace it or be refunded.

Within the next two (2) business days the appropriate “refund” or “product change” form will be sent to you by email, which you will fill in and send it back to [email protected]. Subsequently, and after consultation with you, the Company will send the courier company cooperating therewith in order to receive the product or products to be returned.

Upon receipt of the product from the Company, a detailed inspection will be carried out and, if no problems are found regarding its condition, packaging or documents, an email will be sent as regards the acceptance of your request.

In case the above conditions are met and there is a request for a “refund in cash”, you will be refunded the price you have paid. Shipping costs are not refundable. The way your money will be refunded depends on the payment method you have selected. If the payment is made by credit card, the money will be refunded with cancellation of the relevant charge. If the payment is made by cash-on-delivery or the amount was transferred in the Company’s bank account, the money will be returned by depositing same to your personal bank account, whose details (Bank name, IBAN, Account holder etc.) will be indicated by email at [email protected] within fourteen (14) business days as of the day following the receipt of your request for return of the product or products.

If there is a request to change your product, the new product will be sent to you. Changing products you have already changed is not allowed.

INTELLECTUAL AND INDUSTRIAL PROPERTY RIGHTS – TRADE MARKS

All names, images and trademarks used by the Company are protected or used upon permission of the owner.

Intellectual property is obtained without any wording and without the need for a clause prohibiting any infringements thereof. The Vassaltis and its contents (including all trademarks, distinctive features, patents, brand names, texts, images, graphics, drawings, photographs, programs, informative material of any kind, data, software) constitute intellectual and industrial property of the Company and are subject to protection by the relevant provisions of the Greek, Community and international law. Third parties are not permitted to use: the names of the models, collections, products, services, the company name and all emblems belonging to the Company.

The contents of the Vassaltis are not and should in no way be construed as granting an express or tacit permit/license or right to use any Trademark appearing on it without the written permission of the Company or of third parties which may own the Trademarks appearing on it. Any trademarks, logos, distinctive features appearing on the Vassaltis and depictions of persons or sites or things that form part of its contents are owned by the Company or third parties. Their use is strictly prohibited without the prior written approval of the Company unless otherwise provided in the applicable terms of use.

Any third party’s products, services, brand names, trademarks or distinctive features appearing on the Vassaltis are the intellectual and industrial property of third parties, which are also responsible for them.

LIMITATION OF LIABILITY

The Company makes any effort in order to ensure that the information appearing on the Vassaltis is accurate, complete and updated on a regular basis. By using this website, the visitor and/or the customer accepts and is bound by the terms and conditions applicable on the date of its use.

The Company does not guarantee the completeness of the information contained in the Vassaltis, nor does it guarantee that the use of this website will be without interruptions or errors or that, in the event of errors, they will be immediately rectified. Also, the Company is not liable for any technical problems that may occur to visitors and/or customers upon their effort to access this website, and during their access, which are related to the operation or compatibility of their own infrastructure with this website and does not guarantee protection against electronic viruses or other harmful electronic data, via the use of its website.

The company cannot guarantee the availability of the products, but it can guarantee that it will make any effort possible to inform consumers timely of the non-availability or of any delays in the delivery of the products ordered. The company is exclusively liable for any malice and gross negligence in the event of delay as regards the delivery of the products ordered and for any information or services that the company itself provides via its website.

APPLICABLE LAW AND OTHER TERMS

These terms and conditions, as well as any amendments thereto, are governed and construed in accordance with the Greek law.

If any provision is declared to be null or void, it shall automatically cease to be in force, without the validity of the remaining terms being in any way affected.

For any dispute arising out of the use of the Vassaltis, there shall have jurisdiction ratione materiae the competent courts of Athens.
